You decide to illustrate a blog report with a photograph that you have found on another website. Are there any copyright implications and/or any actions you should take?
If in a situation where you are creating a blog report and wish to illustrate the report with images found on another website, there are many actions (some legal) that you must take before wrongfully and simply copying the image to your work. Copyright in a photograph lasts for the life of the photographers, plus 70 years. If you are wanting to use an image in your work, that you have not taken, there are many copyright implications you must be aware of.
Article 27 of the Universal Declaration of Human Rights states, ‘Everyone has the right to freely participate in the culture of the community to enjoy the arts and to share in scientific advancement and its benefits.’ We are all able to enjoy art and express ourselves, however, another section of the article states, ‘Everyone has the right to the protection of the moral and material interests resulting from any scientific, literary or artistic production of which they are author.’ There are many ways to go about asking for permission to use somebody else’s work. You could offer a license to use the image for a specific purpose for usage of their work. It is rightful to contact the author and ask for permission to use the image, and often an agreement is made by making a payment. Many photographers and artists protect their work through copyright, by restricting and permitting their work it enables them to receive payment for when and if their work is used by others.
Many photographers save their images from being wrongly copied by using the Attribution Right. This gives the authors right to have their name appear next to their image whenever it is exhibited in public, if it appears on television, if it is published or broadcasted anywhere.
If wanting to use another photographers images, to avoid the accusations of copyright, lawfully and morally you should always contact the author for permission, as you do not know the protection they have over their work.
